A judge overseeing a lawsuit brought by Meta Platforms to stop the U.S. Federal Trade Commission (FTC) from unilaterally reopening a 2019 privacy agreement will hear arguments in late January. Meta Platform owns several social media platforms including WhatsApp, Instagram, and Facebook.
In the current dispute, FTC said that Meta misled parents about the control they maintained over their children’s contact in Messenger kids apps along with other issues.
FTC proposed strengthening the 2019 consent agreement. Facebook also had to pay a $5 billion penalty. The recommended changes include preventing Meta from making money off young users, particularly from its virtual reality business, and restrictions on facial recognition technology.
Meta asked to stop the FTC process until a lawsuit challenging the constitutionality of the reopening is resolved. Judge Randall Moss of the U.S. District Court for the District of Columbia will hear briefings on the preliminary injunction on Jan. 29.
In a different case, the FTC has an antitrust litigation against Meta. The watchdog asked a federal court in 2020 to order the company Meta to sell Instagram and WhatsApp. Meta bought Instagram in 2012 and WhatsApp in 2014. There is no trial date on the litigation at the moment.
